Terms of Service
1. Agreement to these terms
These terms govern your use of the ogwa.ai website and, once available, the Ogwa application (together, the "Service"), operated by Ogwa ("we," "us"). By using the Service you agree to these terms. Dealers subscribing to the Ogwa platform will additionally enter a subscription agreement that governs the commercial relationship.
2. The Service
Ogwa is a business-to-business marketing platform for spa and hot-tub dealers. It creates and runs marketing campaigns — landing pages, email, social posts, and Google & Meta advertising — from a professionally authored, compliance-vetted content library; provides cost-per-lead reporting; and includes an AI advisory feature that reads and explains a dealer's own results. The AI feature never writes published marketing copy and never takes actions that spend money; every campaign requires the dealer's explicit approval before it goes live.
Ogwa is currently in private development. A dealer beta is planned to begin in Q1 2027. Until then, the application is not generally available.
3. Eligibility and accounts
The Service is intended for businesses and their authorized representatives. You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for your account credentials and for activity under your account.
4. Beta and pre-release features
5. Your content and your data
Dealers own their business data, their customer and lead data, and the campaigns run on their behalf. Ogwa processes that data to provide the Service, as described in our Privacy Policy. Dealers can export their data — including contacts and leads — in a portable format when leaving the Service, and account deletion deletes the dealer's data except where the law requires retention.
6. Ogwa's content and intellectual property
The Ogwa platform, its content library (copy, designed blocks, templates), and its software are owned by Ogwa or its licensors and are provided for use within the Service. Product trademarks referenced in dealer campaigns (including Hot Spring®, Caldera®, Endless Pools®, and Tylö®) belong to their respective owners.
7. Connected third-party accounts
Dealers may connect their own third-party accounts (for example Google Business Profile, Google Ads, Google Analytics, and Meta accounts) to the Service. Connections are initiated by the dealer and can be revoked at any time. Your use of those services remains governed by their own terms, and Ogwa's handling of data received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements (see our Privacy Policy, §4). Advertising run through connected accounts is billed by the platform in question directly to the dealer; Ogwa never spends without the dealer's campaign approval.
